scraping &#8212; the automated collection of data available on websites. I wrote about this a few years ago in an <a href=\"https:\/\/elementapp.ai\/blog\/linkedin-automation-proceed-with-caution\/\" style=\"color: #0000ff\">article about automating LinkedIn activity<\/a>. LinkedIn automation was a hot topic back then, especially in the context of browser extensions used by recruiters and <a href=\"https:\/\/elementapp.ai\" style=\"color: #0000ff\">ATS systems<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db0b4710 elementor-widget elementor-widget-text-editor\" data-id=\"db0b4710\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>What&#8217;s the case about?<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-594874ba elementor-widget elementor-widget-text-editor\" data-id=\"594874ba\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>hiQ Labs is a startup that provided corporations with data predicting which of their employees were likely to quit. hiQ got this data from LinkedIn, using scraping tools to automatically collect information from public user profiles.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d4a44f93 elementor-widget elementor-widget-text-editor\" data-id=\"d4a44f93\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>It started with a cease-and-desist letter from LinkedIn to hiQ, followed by LinkedIn blocking hiQ&#8217;s access to the platform. hiQ sued LinkedIn, arguing that LinkedIn&#8217;s actions restricted competition and violated state and federal laws. hiQ also claimed that LinkedIn doesn&#8217;t hold exclusive rights to user data, and that collecting publicly available data doesn&#8217;t violate privacy rules.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c912f85b elementor-widget elementor-widget-text-editor\" data-id=\"c912f85b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>First ruling.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d6fb7b46 elementor-widget elementor-widget-text-editor\" data-id=\"d6fb7b46\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In 2017, a California court ordered LinkedIn to give hiQ access to user data. This was LinkedIn&#8217;s first &#8212; and very public &#8212; defeat. The court&#8217;s reasoning included:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6b378eac elementor-widget elementor-widget-text-editor\" data-id=\"6b378eac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul>\n<li>hiQ used publicly available user data.<\/li>\n<li>hiQ acted in the public interest (positive impact on free speech and the economy, unlike LinkedIn&#8217;s actions against hiQ, which restricted competition).<\/li>\n<li>LinkedIn&#8217;s actions made hiQ&#8217;s business impossible, while hiQ&#8217;s scraping had no negative impact on LinkedIn&#8217;s revenue.<\/li>\n<li>hiQ acted in good faith and had informed LinkedIn about its activities.<\/li>\n<li>LinkedIn doesn&#8217;t own the copyright to user data &#8212; the users themselves do.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0f8ef5cb elementor-widget elementor-widget-text-editor\" data-id=\"0f8ef5cb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Second ruling.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-64839483 elementor-widget elementor-widget-text-editor\" data-id=\"64839483\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>LinkedIn appealed, and in 2019 the appellate court ruled that the Computer Fraud and Abuse Act (CFAA), which LinkedIn had accused hiQ of violating, had not been breached. Another win for hiQ.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1af4e1d4 elementor-widget elementor-widget-text-editor\" data-id=\"1af4e1d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Third ruling.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c67b4eaa elementor-widget elementor-widget-text-editor\" data-id=\"c67b4eaa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>LinkedIn appealed again, this time to the Supreme Court, which provided guidance on interpreting the disputed provisions and sent the case back to the appellate court. The new ruling, issued on Monday, April 18, 2022, confirmed that scraping publicly available data does not violate the CFAA.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41e1c50c elementor-widget elementor-widget-text-editor\" data-id=\"41e1c50c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>It&#8217;s not over.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fdd6363f elementor-widget elementor-widget-text-editor\" data-id=\"fdd6363f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>LinkedIn isn&#8217;t giving up and has already announced further legal action to fight scraping.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8bc8c549 elementor-widget elementor-widget-text-editor\" data-id=\"8bc8c549\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Does this case affect regulations in Poland or the EU?<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-47a5d137 elementor-widget elementor-widget-text-editor\" data-id=\"47a5d137\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>No. Poland and Europe operate under different legislation.
